Further to our earlier announcement on 22 January 2019 with regard to the Writ of Summons No. WA-22NCC-82/2018 (the “Civil Suit”), and Statement of Claim filed on 28 February 2018 served on Maybank Trustees Berhad, as Trustee for AmFIRST Real Estate Investment Trust (“AmFIRST REIT Trustee”) we wish to announce that there has been further developments to AmFIRST REIT Trustees’ application to the Court to strike out the Plaintiffs’ claims (the “Application”).

The Plaintiffs’ appeal against High Court’s decision in respect of the Application in the Court of Appeal was dismissed with costs (“Court of Appeal’s Decision”).

The 2nd Plaintiff in the Civil Suit has since filed an application for leave to appeal against the Court of Appeal’s Decision to the Federal Court (“Leave Application”). The Leave Application has been fixed for case management on 7 June 2022 and hearing on 20 June 2022.

In the meantime, the High Court ordered the Civil Suit to be struck out with liberty to be reinstated subject to the decision of the Federal Court ordering for remittance to the High Court.

We will make further announcements as and when deemed appropriate if there are any further developments on this matter.
