With regard to the Originating Summons No.:BA-24NCvC-574-04/2021 (“OS”) between Ho Phoy Kwang & Ho Phoy Chun ("Plaintiffs") and The Summit Subang USJ Management Corporation (“MC”) ("Defendant") issued by the Shah Alam High Court, we wish to announce that on 30 April 2021, the Plaintiffs filed the aforesaid OS against the Defendant (“MC”) seeking, amongst others :-

1. A single uniform rate in proportion to the allocated share units from 1 January 2013 until the date before the next management period commences.

2. An order under Section 76 of the Strata Management Act 2013 (“SMA”) that an administrator for the MC be appointed for a fixed period.

Maybank Trustees Berhad (“MTB”) legal, economic and commercial interests will be adversely affected in the event the OS is allowed by the Court as MTB owns approximately 87.2% of the share units in The Summit Subang USJ mixed integrated development, on 7 September 2021, MTB filed an application to intervene in the OS and be added as the 2nd Defendant which application was allowed by the High Court on 8 December 2021.

On 27 December 2021, the Shah Alam High Court allowed MTB to file an affidavit in respect of the application filed by the MC to convert the OS into a Writ (“Enclosure 6”).

The next case management dates for Enclosures 6 and 1 is on 11 February 2022 and 28 February 2022 respectively.
