Further to our announcement on 6 March 2018 with regard to the Writ of Summons and Statement of Claim filed on 28 February 2018 served on Maybank Trustees Berhad, the trustee of AmFIRST REIT (“AmFIRST REIT Trustee”) (i.e. Suit No. WA-22NCC-82/2018 (the “Civil Suit”)), we wish to announce that there have been further developments to the Civil Suit.

By way of application dated 17 April 2018, AmFIRST REIT Trustee applied to the Court to strike out the Plaintiffs’ claims (the “Application”). The Application was heard on 27, 29, 30 August 2018 and 10 October 2018 and was subsequently fixed for decision on 12 December 2018.

On 12 December 2018 as regards to the Application, the Court exercised its inherent powers to stay the Plaintiffs’ claims against AmFIRST REIT Trustee in the Civil Suit, pending the disposal of related claims, currently pending before the Strata Management Tribunal between the Plaintiffs and The Summit Subang USJ Management Corporation (i.e. the 1st Defendant).

Given the decision of the Court on 12 December 2018, a 5-days trial which was initially fixed from 14 to 17 January 2019 and 30 January 2019 would no longer proceed.

The Plaintiffs have 30 days from 12 December 2018 to file their appeal.

We will make further announcements as and when deemed appropriate if there are any further developments on this matter.
