Reference is made to the announcement dated 21 June 2016. Nestle Products Sdn. Bhd. (“Nestle”), through a Notice of Motion dated 29 July 2016 filed with a certificate of urgency, applied for an interim stay of proceedings of CTL’s claims against Nestle Asean Sdn. Bhd. and Cereal Partners Sdn. Bhd. in the Shah Alam Magistrates Court and against Nestle Manufacturing Sdn. Bhd. in the Shah Alam Sessions Court (“Interim Stay Motion”). The Interim Stay Motion was fixed for hearing on 8 August 2016 where the Court of Appeal allowed Nestle’s Interim Stay Motion with costs in the cause. Nestle has also appealed against the decision of the Consolidation Application to the Court of Appeal (“the Appeal”). The Appeal is fixed for Case Management on 11 August 2016.
