Reference is made to the announcement dated 6 November 2015.
The Board of Directors of Century wishes to announce the proceedings during the case management in the Kuala Lumpur High Court (“KLHC Suit”) on 27 November 2015 and 2 December 2015.
On 27 November 2015, parties informed the court that there would be no objection to (i) Nestle Products Sdn Bhd’s (“Nestle”) application for Joinder of Nestle Asean (Malaysia) Sdn Bhd, Nestle Manufacturing (Malaysia) Sdn Bhd and Cereal Partners (Malaysia) Sdn Bhd as parties to the KLHC Suit and subsequently, (ii) CTL’s application for transfer and consolidation of the KLHC Suit to the Shah Alam Suit No. 22NCVC-529-10/2015 (“Shah Alam Suit”) (“the Applications”) subject to there being no concession to the contents of the affidavits filed for both the Applications (“the Terms”).
The Registrar fixed for this matter to be called up before the Judge on 2 December 2015 for the Terms to be recorded.
On 2 December 2015, the parties recorded the Terms before the Judge. Nestle will be serving its Amended Writ and Statement of Claim and upon the exhaustion of the pleadings for the KLHC Suit, CTL’s solicitors will arrange for the transfer of the KLHC Suit to the SAHC Suit.
The next case management for the SAHC Suit is on 13 January 2016.
