Reference is made to the announcement dated 16 October 2015.
The Board of Directors of Century wishes to announce the proceedings during the case management in the Kuala Lumpur High Court (“KLHC”) today.
CTL’s solicitors informed the KLHC as follows:
a. CTL had entered appearance to the claim on 26 October 2015;
b. CTL had filed and served an application on 26 October 2015 to consolidate this suit with Suit No. 22NCVC-529-10/2015 (“Shah Alam Suit”) in the High Court of Malaya at Shah Alam (“SAHC”) and to transfer this suit to the SAHC; and
c. CTL had asked for further and better particulars of Nestle Products Sdn. Bhd. ("Nestle")’s Statement of Claim on 26 October 2015.
Note: In the Shah Alam Suit, CTL claims against Nestle for RM8,443,384.75 being damages as well as RM79,044.31 being outstanding sum for services rendered.
CTL’s solicitors asked for the filing of the Defence to be deferred.
Nestle’s solicitors informed the KLHC that Nestle would be filing an application to amend its Writ and Statement of Claim.
The KLHC directed as follows:
a. The filing of CTL’s Defence be deferred pending Nestle’s Amended Statement of Claim.
b. The case be fixed for mention on 5 November 2015 for Nestle’s solicitors to update the KLHC on the amendment to the Writ and Statement of Claim.
